Terms of Service

These Terms of Service ("Terms") govern your use of the Digest IT Hub website (digest-it.com) and any web development, mobile app development, AI solutions, cybersecurity, SEO, or related IT services ("Services") we provide. By using our website or engaging our Services, you agree to these Terms.

1. Our Services

Digest IT Hub designs, builds, and maintains digital products for clients, including but not limited to websites, mobile applications, AI-powered tools, and IT support services. The specific scope, deliverables, timeline, and cost of any engagement are agreed separately in a written quotation or proposal before work begins.

2. Quotes & Project Requests

Submitting a request through our "Get a Quote" form does not create a binding contract. A project only begins once both parties agree in writing to the scope, price, and timeline. Quoted prices are estimates based on the information provided and may be revised if project requirements change.

3. Payment

Unless otherwise agreed, projects are billed according to the payment schedule set out in the project proposal (e.g. a deposit before work starts, with the balance due on delivery or in milestones). Late payments may result in paused work or delayed delivery.

4. Revisions & Delivery

Each project includes a reasonable number of revisions as agreed in the proposal. Requests that fall outside the original scope may be treated as additional work and quoted separately.

5. Intellectual Property

Upon full payment, ownership of the final deliverables (code, designs, and content created specifically for the client) transfers to the client, except for any third-party tools, libraries, frameworks, or licensed assets used in the build, which remain governed by their own licenses. Digest IT Hub retains the right to showcase completed work in its portfolio unless the client requests otherwise in writing.

6. Third-Party Services

Our Services may rely on third-party platforms (such as hosting providers, payment gateways, Firebase, or messaging platforms like WhatsApp). We are not responsible for outages, changes, or issues originating from these third-party providers.

7. Warranties & Limitation of Liability

We aim to deliver reliable, well-tested work, but Services are provided "as is" without warranties beyond what is explicitly agreed in writing. To the fullest extent permitted by law, Digest IT Hub is not liable for indirect, incidental, or consequential damages arising from the use of our Services or website.

8. Termination

Either party may terminate an ongoing engagement with written notice. The client remains responsible for payment of work completed up to the termination date.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of our website or Services after changes are posted constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the Republic of Kenya.
